This thread exposes a major problem for ICE, the Canadian Consulate, and IRCC.

ICE has been trying to obtain an Emergency Travel Document (ETD) from the Canadian Consulate. But that doesn't make sense because they already have that Canadian passport, and if I am the person who was born Ricky Riess in Sudbury, Canada, as ICE and IRCC are claiming, then ICE wouldn't need to obtain an ETD - they could deport me using that Canadian passport. A Canadian passport is a travel document and can be used for removing a person to Canada.

The fact that the Canadian government is not allowing ICE to use that passport for the purposes of removal means they must have revoked it as being fraudulently obtained. Which means the Canadian government acknowledges I am not the person named on the passport - I am not the person who was born Ricky Riess in Sudbury, Canada. But that's who ICE is trying to deport me as, and that's who IRCC is considering accepting me as.

Moreover, if I'm not the person who was born Ricky Riess in Sudbury, Canada, then there is no evidence I am a Canadian citizen ... in fact, there is no evidence of who I am at all!

I need some advice. I know I sent in this request before, but since it is not in this case I'm afraid I may have goofed.

We have run into a situation with an inmate who is currently in ICE custody. This inmmate had no problems corresponding with us throughout his incarceration,

This is nonsense. Look at my correspondence with the Canadian Consulate, while I was in the Maricopa County Jail, before I was transferred back to ICE custody. There were only three letters from me, all of which were responses to letters she had sent me:

2010-06-30: In the first letter I was just asking how she came to know about me and that I was in the Maricopa County Jail.
2010-08-20: In the second letter, I was just thanking her for her concern and offer of assistance. But I politely declined any assistance.
2010-11-29: In the third letter, and this is before I returned to ICE custody, I was clearly and unequivocally informing her that I am not claiming to be a Canadian citizen or to have been born in Canada. And I explained that the reason I was telling her that was because I did not want to run into legal problems in Canada if they issued me a travel document based on their assumption I was a Canadian citizen.

In response to my third letter, it was Dextraze who wrote back, stating that the US had already determined I am a Canadian citizen, and her office confirmed that when they issued a travel document in my name. She was the one insisting I was a Canadian citizen.

This is false! As shown in the commentary above, I actually informed Dextraze I am not a Canadian citizen in my 2010-11-29 letter, while I was still in MCSO custody. Nothing changed, in that respect, after I was transferred back to ICE custody.

Have a look at my letters to Dextraze following my return to ICE custody:

On 2011-03-01, I sent her an Emergency Travel Document (ETD) application 2011-03-01. She did not respond.
On 2011-03-29, I sent her a formal, written request for an ETD 2011-03-29. She did not respond.
On 2011-04-07, I sent her a letter inquiring what information she had issued the previous travel document based on 2011-04-07, so that I could use that same information in a request for a new ETD. She did not respond.
On 2011-06-17, I sent her another formal, written request for a travel document, asking whether if I provide the information relating to Ricky Riess on the application, that would help in the issuance of the ETD 2011-06-17. She did not respond.

ICE would very much like to remove subject to Canada, however they have not yet sent us a completed ppt application.

I have scanned in subject's correspondence so you can see first hand subject's non-cooperation, and would be grateful for guidance. Can ICE submit a request for a travel document on subject's behalf even though he claims not to be Canadian?

As you will see from subject's previous ppt records, he was issued a travel document some time ago.

Hi Marie,

We've reviewed the notes and previous ppt records for the subject. We understand from your previous note that he has declared himself a victim of identity theft and are surprised he is not more willing to provide sufficient information to prove he is not our subject.

However, from PPTC's perspective: this is a deportation case and the information held on file so far seems to indicate that the person in ICE custody is indeed our subject (based on last name, first name, DOB, and signature we can make a preliminary determination that he is same as). We notice the letter of facilitation from 2009 and the information provided for the letter contain much more information which further substantiates the same as determination (mother's maiden name, POB, photo) and we also noticed fingerprints were on file.

We suggest ICE takes a photo for verification purposes and if that proves inconclusive, perhaps the fingerprints on file can be sent to RCMP for further verification.

I spoke with ICE supervisor and advised of all info from note 19. They are relieved, and will work with their legal department. They do not expect subject to cooperate with completion of ppt application and are seeking further guidance from us.

Subject has previously been prosecuted and convicted of falsely claiming to be a US citizen. Contact details for SEATL/RCMP Liaison Officer Peter Lea provided to ICE.

We have been provided with series of photos of subject. When compared to previous ppt record, we are confident subject is RIESS.

PPSD: please clarify how to go about application of subject refses to complete application.

Hi Marie,

As with any application for travel document service, PPTC requires a duly completed form, all supplementary info and fees to be paid before issuance is considered. Whether the subject/applicant is cooperative, in the case of deportation/removal, ETD issuance will occur. If you anticipate applicant will not fill out form willingly, then a case worker or deportation officer may do it, provided usual requirements are met. If you anticipate applicant will not sign the form, you may opt to record that applicant does not sign and waive the required signature. As you can see, there are ways to negotiate around an uncooperative applicant in order to satisfy the requirements.

Proof of Canadian citizenship:

I note the scanned copy of Mr. Riess’ Ontario birth certificate. Is the original in ICE's possession? If so, would it be possible to send it to us for submission to Passport Canada?

Money Order:

Money order made out to the Consulate General of Canada - $31 US

As discussed previously, we will wait until the file has been examined by Passport Canada to request the itinerary, which will be the last thing we need to meet the requirements for issuance of the ETD.

Received enclosed forms yesterday. Email sent to DO advising that application as is cannot be accepted, reasons provided. No response yet, I am ready to return the application should they wish to amend this one as opposed to starting from scratch.

Also received yesterday letter from subject requesting an update on issuance of ETD. In letter, he asks if it will help or increase his chances of obtaining a travel document to Canada once his perjury and false personation convictions are vacated.

I contacted ICE, who advised that subject does not have any outstanding charges in the US, and has felony convictions for perjury and false impersonation. Those convictions cannot be vacated ICE should have sent in new ppt forms by now, and we will advise once received.

Please note that I have agreed to request the itinerary once file has been considered by PPSD and all modifications that must be made have been completed. ICE does not yet know how they will send subject back to Canada, whether as an escort on a direct flight or through their internal airline (called JPAT flights) and escorted to the border.

Good afternoon, gentlemen,

I've just received a call from Mr. Riess, requesting an update on the status of his travel document. I explained that I was still waiting to complete an application to enable me to consider it. He asked what was missing, and I went over the latest applications with him: no applicant's signature (will not sign as he could be prosecuted for providing false information), no declaration of applicant on page 2,

I had expressed my concern to Dextraze, that if I knowingly put false information on the application, then sign where it says "I solemnly declare ... that all statements made in this application are true", then I would be setting myself up to be arrested upon my arrival in Canada.

I had sent Dextraze a letter, expressing my willingness to put false information on the application if it will ensure the issuance of a travel document letter to Dextraze, 2011-06-17. But she refused to respond or to suggest in writing that I should do that. If Dextraze had advised me to do that, then I could have used her advisement as a defense if the Canadian authorities prosecuted me for making false statements on the ETD application.

But also, the lack of the signature shouldn't have mattered because Dextraze had already informed Leal that if I refuse to sign then it will be sufficient for him to note that and to submit the application without the signature emails dated 2011-08-09 11:15 AM; 5:10 PM.

How can this possibly matter? They know that I've been in custody since 2007. What is the point in making a big deal about requiring ICE to state something, which is completely irrelevant, on the form if they already know that information?

I'm really starting to get the impression the Canadian authorities are just making up requirements to delay or avoid issuing the travel document. Either that or these people are so fucking braindead that all they know is how to go through the sequence of steps they were trained to do, regardless of how pointless, irrelevant, and stupid those requirements are. I mean, on the one hand, they're talking about assisting ICE with my removal and saying that a travel document will be issued no matter what; but on the other hand they're imposing unnecessary requirements on me which they know I can't possibly fulfill.

He advised he would not be able to provide me with the references as he is a loner and has not kept touch with anyone. I explained a reference does not need to be a close friend, simply someone who would have known him for at least 2 years who can verify his identity. I requested that he be in contact with his DO and that at this point I am relying on him to complete the application. He said that if I wanted to issue a TD for Ricky Riess of Toronto, that I could go ahead. I explained I am not issuing a TD to Ricky Riess. I asked him about his conviction for false impersonation of a US citizen, and he said that's under review (a 2055 motion? - something about non-legal representation). I did not ask about the whereabouts of his birth certificate, American or otherwise. He wanted me to put in writing that we spoke and confirm what we had discussed. I said I would not be duplicating the instructions clearly provided on the passport application, but that our conversation would be noted.
