Criminal Prosecutions, Deportation, DHS Detention, and Family Court - Good Times!

In the "Canada vs Patrick Fox" section you'll find the mountain of evidence proving I didn't commit criminal harassment against my ex-wife, Desiree Capuano; that the prosecution knew that; but that they prosecuted me and sent me to prison for it nevertheless. You will see the proof that the prosecution and the lawyer forced on my by the court, against my will, knew Desiree was committing, literally, hundreds of instances of perjury at the trial but they refused to inform the jury or the judge.

And, you will hear about such outrages as the time I was convicted and sent to prison for violating a probation condition even though I wasn't even on probation at the time. And about the time I was convicted and sent to prison for violating another probation condition which required me to remain in BC, Canada even though it was the Canadian government who had effectively removed me from Canada.

And then there's the time I caught the Vancouver Police Detective committing perjury on the witness stand at one of my trials and I confronted him on it. He begrudgingly admitted he had lied. And then the judge completely ignored that fact.

Or the time the prosecution admitted, on the record, at one of my bail hearings, that the BC government believes I am playing a game of chicken with them and due to the media attention my cases have gotten, it is critical that the government not be the one to blink in that game of chicken. Then, when I subsequently referred to that admission by the prosecution, the judge belligerently insisted the prosecutor never said that. But I have the transcripts of the prosecutor saying it, and of the judge insisting he didn't say it, right here on this website.

Or the time the prosecutor adamantly insisted, in court, on the record, that my US birth certificate was NOT admitted as an exhibit in the criminal harassment trial, even though the official court exhibit list clearly shows it was part of exhibit 2. Moreover, it was admitted as an exhibit by the prosecution - not by me.

And there's the time I caught the prosecutor, Chris Johnson, lying to the court and claiming I was the one lying; then when I tried to show the judge the proof it was Johnson lying, the judge refused to let me present it.

Yes, there's just no shortage of amazing corruption and abuses that go on in the Canadian justice system - and the prosecutors, lawyers, and judges make absolutely no attempt to be discreet about it.

This section also covers the phenomenal blunder of the Canadian government allowing the US to deport me to Canada, knowing I'm not a Canadian citizen, and their efforts to try to keep me in Canada against my will by refusing to acknowledge I'm not a Canadian citizen.

In "United States vs Patrick Fox", we look at the surreal drama of the US Department of Homeland security illegally detaining me in an immigration detention facility over a four year period, based on an unsupported allegation that I was an illegal alien.

To be clear, DHS (or specifically, ICE) arrested and detained me with absolutely no evidence that I was even an alien; shipped me off to a detention facility, literally, in the middle of nowhere Arizona, then told me if I want to get out of custody I have to prove I'm a US citizen. Then, when I eventually went before an Immigration Judge, asserted my US citizenship, and DHS admitted they had no evidence I was an alien, the Immigration Judge actually postponed the hearings indefinitely, allowing DHS to continue detaining me illegally, so DHS could try to find some evidence I was an alien.

At one point, after detaining me for eight months, the Immigration Judge told DHS that unless they can provide some evidence that I am the person they were claiming I was, he was going to dismiss the case. DHS contacted the Toronto, Canada police who provided them a mugshot and fingerprints of that person, but that mugshot and fingerprints didn't match me. So, DHS's response was to charge me with perjury and false claim of US citizenship. That resulted in nine months in US Marshals custody, a criminal trial in the US District Court, and a conviction. DHS then used that conviction for false claim of US citizenship as the proof that I am not a US citizen, and based on that, the Immigration Court ordered me removed from the US.

Eventually, after four years, I was released from DHS custody. But then, a year and a half later, ICE came to my home in Los Angeles, arrested and detained me again, and actually deported me to Canada. I subsequently returned to Los Angeles, then ICE came to the courthouse where I was attending a family court hearing, arrested and detained me, and deported me to Canada a second time.

We also review the forgery case brought against me by the Phoenix Police and the Maricopa County Attorney's Office. The detention related to this case is what resulted in me being taken into custody by ICE. I represented myself in this matter and, ultimately, all charges were dropped. Regardless, I was still held in the county jail, without bail for about 13 months before the charges were dismissed.

And, we talk about that perjury and false claim of US citizenship case DHS brought against me. Almost immediately following my arrest on the false claim of US citizenship charge, the US Attorney offered me a plea agreement of time served if I pled guilty. I believe the sole purpose of this case was to get me to plead guilty to the false claim of US citizenship charge because if I'm convicted of that then under the doctrine of res judicata the Immigration Court would not be able to make a finding contrary it. In other words, if I'm convicted of false claim of US citizenship in the US District Court, then the US Immigration Court would have to also find that I am not a US citizen - regardless of what physical proof to the contrary I might present. It also means, that that conviction alone, would be sufficient proof I am not a US citizen, so DHS would not actually have to provide any evidence of it.
