Dear Miss. Dextraze:

First, I thank you for taking the time to speak to me on August 18, 2011.

This letter serves to confirm and clarify the relevant points of our discussion. If I am incorrect, or have misunderstood any of your statements please let me know at your earliest opportunity. Otherwise, I shall conclude that we are in agreement on the matters referenced herein.

  1. In response to my request for the status of issuing a travel document for me, you replied that you are not able, based on the facts available to you, to issue me a travel document.
  2. You have been in contact with ICE regarding the issuance of a travel document for me.
  3. You have determined I am not Ricky Riess, born in Sudbury, ON on November 24, 1973.
  4. You have determined I am not the person named on the passport ICE has in their custody.
  5. You have no evidence, or reason to believe I am a Canadian citizen.
  6. Your belief that I am not a U.S. citizen is based only on the fact that I was convicted of false claim of U.S. citizenship (which conviction was based solely on the existence of the passport mentioned above) and ICE’s insistence that I am NOT a U.S. citizen. You have no evidence to support the claim that I am not a U.S. citizen.
  7. I have never told you or lead you to believe I am a Canadian citizen and I have never told you or lead you to believe I am Ricky Riess from Sudbury, ON.
  8. You have no proof or evidence that I ever signed the declaration under penalty of perjury, on any Canadian passport application.
  9. You will not provide me any further assistance in obtaining a travel document.
  10. You instructed me to direct any further inquiries or concerns to my Deportation Officer, Michael Leal.
  11. I asked you, if I filled out and signed a Canadian passport application, claiming to be a Canadian citizen would I be prosecuted for perjury or passport fraud upon my entry into Canada. You refused to answer that question, stating only “I’m not the police”.
  12. I informed you my perjury and false claim of U.S. citizenship convictions were still under review, pursuant to 28 U.S.C. § 2255, for ineffective assistance of counsel.
  13. I requested you provide me a written statement of the status of my request for a travel document and of what we were discussing at that moment. You refused.
  14. You have not responded to any of my letters since December 17, 2010.
  15. You have not told ICE that you intend to issue me a travel document or that a travel document is forthcoming in the reasonably foreseeable future.
  16. You agree that I have made sincere efforts and inquiries to obtain a travel document for Canada and I have not made any attempts or efforts to obstruct or impede the issuance of a travel document.
  17. On March 1, 2011 I filled out and sent you a Canadian passport application containing what I declare under penalty of perjury to be complete and true information. You did not respond and had not informed me the information was incomplete or believed to be incorrect.

If I have missed some relevant point please let me know. And again, if you disagree with any of these statements please inform me in writing at your earliest opportunity. Your failure to do so will indicate your acceptance of the statements as facts.
