R. v. Fox; IRCC [Patrick Fox; Mark Myhre (BCPS)]
Mr. Myhre:
May you please inform me when you've established contact with IRCC and received whatever information they provide you regarding my status?
Thank you,
Patrick Fox
Mr. Fox,
I spoke with Patti Tailleur at CBSA today. She confirmed that in the CBSA's view you are Canadian, based on the computer entry you put before the court. Ms. Tailleur would not, however, put that in writing because "it's not our investigation". She did give me the name of someone at IRCC I could try to speak to, but they did not pick up their phone today the three times I've called.
I also attended 1148 Hornby, saw that entry was only allowed by appointment, and sent an email to the email address on the door asking for assistance.
I also had the attached correspondence with your father.
I also obtained the attached decision in your appeal of your perjury conviction. I note that you told a Maricopa sheriff you were born in Sudbury, Ontario, Canada.
I will let you know if/when I hear back from IRCC.
Mark Myhre
Mr. Myhre:
Thank you for the information.
With respect to a DNA test I am all for it - as I have said repeatedly over the past few years. You guys already have my DNA so yes, please, ask Mr. Riess to provide a DNA sample for the purposes of determining parentage. I look forward to receiving and publishing those results. If you need another sample from me I'm more than willing to provide it. Of course, my participation, as always, is contingent on me receiving a verifiable copy of the test results to publish.
With respect to CBSA - they are an enforcement agency (like ICE). CBSA does not make determinations of citizenship. They only enforce orders or directives made by the immigration court and/or IRCC. Only IRCC can definitively say someone is, or is not, a citizen or what their status in Canada is. Without clear proof a person present in Canada is an alien, or documentation or instruction from IRCC, CBSA is not legally authorized to attempt to remove them. Until they receive that documentation or instruction from IRCC they will do nothing. I have a copy of such documentation.
Anything related to the perjury conviction is irrelevant because a conviction is not actual proof that the allegation was true. You're a prosecutor, you should know that. And, I never told the Maricopa County Sheriff I was born in Sudbury, Ontario, Canada - that is what the deputy testified at the perjury trial but, not surprisingly, there is no official record I ever said anything to that effect: no DHS forms or admissions by me at the time of my booking (the deputy testified that he believes I said it while I was being booked in but he can't be completely certain), yet he could not explain why he, or the supervising ICE agent never processed me or had me sign anything at that time.
I don't understand why this is so hard for you and why you're doing all this roundabout stuff. There is only one thing which matters: IRCC! They say I'm not a citizen and have no status and I'm not disputing that. That is the ONLY thing which matters - not Steve Riess; not CBSA; not the Maricopa County Sheriffs; not ICE or the US District Court or the Court of Appeal for the Ninth Circuit.
Anyway, thank you for putting some effort into this. I look forward to seeing how all of this is going to play out. Have a good weekend (really, I'm not being sarcastic).
Sincerely,
Patrick Fox
You’re welcome. You too.
