Re:
Request for testimony and DNA test

Dear Mr. Riess:

I am writing to inquire whether you would be willing to testify at my ongoing trial; and, to formally request your participation in a DNA test.

With respect to testifying, it is my understanding that arrangements can be made for you to appear by video link, from Sudbury, rather than having to travel to Vancouver.

Please be aware, this request is coming from me – NOT from the Crown. The Crown Counsel explicitly DOES NOT want you to testify in this matter. I have brought it up a number of times at pre-trial conferences and the Crown has consistently opposed it. Nevertheless, MY interest is in getting to and exposing the truth of the matter – officially, publicly, and on the record – and for those reasons, I believe your testimony is crucial.

If you are not willing to testify, then I shall seek to have your previously video recorded, sworn KGB statement admitted in place of your testimony.

And, with respect to a DNA (paternity) test, I firmly agree with you that it should be done. I also have been insisting on it, but again, Crown Counsel has fervently opposed it – as have both the BC Supreme Court and the BC Provincial Court, CBSA, and the RCMP. Fortunately, we do not need to go through them to have it done. Anyone who can pay for it can have a DNA based paternity test done. I would definitely like to proceed with this. The only conditions I would ave is that the results MUST be verifiable by a third party; and I must be able to publish them.

Sincerely,

Patrick Fox
