Jennifer Wiles represented ICE/DHS at two of the hearings in my removal proceedings TR 2007-10-31; 2008-05-05.

The 2007-10-31 hearing was my first appearance in the Immigration Court. DHS had absolutely no evidence of alienage, they had not even established I was an alien. And for that reason, neither ICE nor the Immigration Court had any jurisdiction over me at that point.

Prior to the 2008-05-05 hearing, ICE had obtained a Canadian passport with my name and photo so, admittedly, at that hearing ICE had a legitimate basis for their allegation of alienage. They had not, however, verified the passport was legitimately issued (meaning, not fraudulently obtained), or that I was actually the person the passport represented. That is significant because I had consistently claimed I had obtained the passport fraudulently and was not the person named on it.

Wiles Lied to the Court About Cordero's Efforts to Obtain My Birth Certificate

At the 2007-12-31 hearing, Wiles falsely claimed my Deportation Officer, Robert Cordero, had been "attempting to get a copy of his birth certificate either from Ontario, California, or Ontario, Canada" TR 2007-10-31 p10l23-25. That is completely false!

By his own admission in his sworn declaration, Cordero presented me with an application for a San Bernardino County birth certificate on 2007-10-04, but did not submit it until 2007-11-08 Declaration of Robert Cordero ¶5; ¶9 - AFTER this hearing, AFTER Wiles told the court he had already done so.

Wiles Tells the Court I've Been Refusing to Cooperate in the Prosecution Against Me

At that hearing, Wiles also made a point of telling the Immigration Judge I have "not really helped the deportation officer out at all" and that I've "been very obstinate in that" TR 2007-10-31 p10l25-p11l2. And that "[Cordero] has asked several times for him to provide the certificate or information for my officer to obtain that, and the respondent has not done so" TR 2007-10-31 p11l2-4.

I find it very troubling that Wiles would say that, considering ICE had not established alienage, didn't have the legal authority to arrest me or to be detaining me, and that absolutely no burden was on me to prove I was a US citizen.

Wiles Falsely Claimed the Passport Was Seized from My Possession

At the 2008-05-05 hearing, Wiles falsely told the Immigration Court the Canadian passport which ICE had obtained with my name and photo was was obtained from the vehicle I was driving when I was arrested by the Phoenix Police Department TR 2008-05-05 p30l6-7.

In fact, the passport was seized from a third party, who had been using it to cash forged checks in my name Phoenix Police report, 2007-04-05.

Presumably, since Wiles knew the passport was seized from a vehicle during an arrest, she had reviewed the police reports, which means she was aware it was seized from someone else's possession, not mine.

There has never been any evidence the passport was ever in my possession.

Wiles Lied to the Court About the Canadian Consulate Verifying I Am A Canadian Citizen

At the 2008-05-05 hearing, the Immigration Judge asked Wiles if she had been in contact with the Canadian Consulate, and Wiles responded that they had and that the Canadian Consulate verified I was a Canadian citizen TR 2008-05-05 p30l9-12.

However, records from Global Affairs Canada's Case Management System (COSMOS) show that on 2008-04-02 they were contacted by my Deportation Officer Keith Acosta, who asked them to verify whether a Canadian passport bearing my name and photo was valid Case Note, 2008-04-02. Then, on 2008-04-15, there is a follow-up case note where the Consular Officer reports that she told Acosta she cannot verify any information for him regarding citizenship Case Note, 2008-04-15.

Clearly, the Canadian Consulate most certainly DID NOT verify I was a Canadian citizen as Wiles claimed to the court.

Wiles Lied to the Court About Not Having Had the Chance to Compare My Fingerprints

At the 2008-05-05- hearing, Wiles also falsely claimed DHS has not had the chance to compare my fingerprints to those of Ricky Riess from Canada to determine whether I am him TR 2008-05-05 p30l17-p31l3.

That is also false. As I pointed out in court, DHS had had my fingerprints for seven months and could have compared them to Ricky Riess's at any point during that time TR 2008-05-05 p36l19-23.

It is simply unfathomable that in seven months they did not once have a single opportunity to forward my fingerprints to the RCMP for comparison!

And so, I guess that's all there is to say about Jennifer Wiles. Just another lying, cheating, ICE lawyer.
