IRCC GCMS Information Request: Application (2025-02-19)

Synopsis

This GCMS report, related to my application for a Certificate of Citizenship Records Search, was created on 2025-02-19. The critical part of this report is the "Client Details" section. The Client Details section contains IRCC's information pertaining to the person, not to any particular application.

Background

At some point prior to 2008-05-05, IRCC had created a record of me in their, now obsolete, Field Operations Support System (FOSS), under the name Richard Riess with the UCI number 6002-8504 FOSS report, 2025-02-28. That was long before I had had any contact with IRCC or CBSA. Hell, I had never even heard of IRCC and CBSA. So where they got the information about me is anyone's guess.

In that FOSS report, the "Country of Birth" field states "United States of America", and the "Citizenship" field states "Unknown". Even still, knowing I was born in the US and had no immigration or citizenship status in Canada, Canada repeatedly provided DHS emergency travel documents (ETDs) for them to deport me to Canada.

On 2019-01-18, IRCC created a new record for me in the Global Case Management System (GCMS), under the name Richard Riess with the UCI number 6002-8504 GCMS report, 2023-07-14. And again, they entered my Country of Birth as United States of America, and citizenship as blank, meaning "Unknown". This was AFTER they had repeatedly allowed the US to deport me to Canada.

On 2019-03-15, I turned myself in to CBSA at a Canadian port of entry so I could be deported from Canada. The CBSA officer I interacted with acknowledged I was born in the US, had no status in Canada, and was inadmissible. But in the notes she entered into GCMS, she only stated "At this point, it cannot be confirmed that subject is NOT a Canadian..." GCMS report, 2023-07-14.

And still neither CBSA nor IRCC changed the "Country of Birth" field.

IRCC Issues Me A New UCI Number, Creates A New GCMS Record

Then, on 2019-03-23, eight days after I turned myself in to CBSA to be deported, after they did whatever investigation into my identity and reported back to IRCC, IRCC created a new entry for me in GCMS. The new entry was under my real name, Patrick Fox. And they assigned me the new UCI number 11-1170-2257.

The new record made no reference to the name "Richard Riess", the UCI number 6002-8504, or any of my prior dealings with IRCC or CBSA GCMS report, 2025-02-19.

The new record was also not linked to any previously issued or fraudulently obtained travel documents, or information about my deportations to Canada.

And most significantly, notice that even though they created a whole new record, based on the information available to them as of that time, and with no references to any of the old information, they STILL stated my Country of Birth as United States of America! Clearly, after more than ten years of dealing with me, that is not an oversight. It was deliberates.

IRCC could have simply changed the name, or added the name Patrick Fox, to the existing record under the UCI number 6002-8504, but they opted instead to create a new record with no links or references to any of the information under the name Richard Riess. I believe that was done deliberately, because they acknowledge I was not born in Canada, am not a Canadian citizen, and they should never have allowed the US to deport me to Canada.

I did not become aware IRCC had created a new GCMS record and issued me a new UCI number until I received this GCMS report on 2025-02-27.

On 2023-11-16, under the advisement of IRCC, I submitted an application for a Certificate of Citizenship Records Search, to try to obtain formal documentation supporting my insistence I have no status in Canada. In that application, I included my legal name (Patrick Fox), and my prior name (Richard Riess). I also included the UCI number assigned to me under the name Richard Riess GCMS report, 2024-05-06. I was not aware, at that point, that IRCC had assigned me a new UCI number or created a new GCMS record for me.

When IRCC merged the information from the temporary record created on 2023-11-16, with my permananet record under the name Patrick Fox, they expressly excluded any references to the name Richard Riess and the UCI number 6002-8504, ensuring that none of my history with IRCC and CBSA, including the previous travel documents, and my illegal deportations to Canada, would not be available under my real name.

And finally, toward the end of this report, you will notice there are two "Notes" records which contain fairly lengthy contents, but which IRCC withheld from disclosure, citing the Privacy Act section 22(1)(b), which relates to information which could be expected to be harmful to an investigation. I suspect those notes also relate to the documents supposedly establishing my Canadian citizenship - namely, Ricky Riess's birth certificate and a letter from US ICE stating I am Ricky Riess from Sudbury, Canada.

It's interesting that in their letter acknowledging I've never been issued a certificate of citizenship Letter, re: Records Search, 2025-01-28, IRCC defers to the government of Ontario, claiming the fact that Ontario issued me Ricky Riess's birth certificate establishes my claim to Canadian citizenship, because IRCC themselves have issued me Ricky Riess's passport. Why didn't they just rely on the fact that they issued me that document to establish my supposed claim to Canadian citizenship? Perhaps because that would put the blame on them instead of on the government of Ontario, perhaps?

Ultimately, what all this shows is that IRCC acknowledges I am Patrick Fox and was born in the US, not Richard Riess and not born in Canada. And yet, they still refuse to directly state I am not a Canadian citizen and they refuse to let me leave Canada.

    On 2023-11-16, I submitted an Application for A Search of Citizenship Records (application #: SR00010791).

    It has now been more than one year and I've received no response or update on it. Also, there have been no updates or activity shown on the Government of Canada website.

    Prior to submitting the application, I was told by IRCC Agent #5653, Olufemi, that in order to obtain proof I am NOT a Canadian citizen I would have to apply for a Search of Citizenship Records and that that could take up to 15 months. So I applied for it, and I've now been sitting in limbo for 12 months. I have the emails from Agent #5653, Olufemi, if you would like to see them.

    May you please inform me of the status of this application? And possibly provide some idea of how much longer this may take?

    The purpose of this communication is to inform you, with respect to my application, the only identification documents I currently possess are a BC driver's license and a Florida birth certificate. I understand a birth certificate is not an acceptable piece of ID, however it is all I have because I have no status in Canada and I was in jail here for most of 2016 through 2023. Your records (FOSS and GCMS) correctly state I was born in the US, but the citizenship field is blank. I am not making any claim of being a Canadian citizen; I do not want Canadian citizenship; I am not trying to trap you guys into saying something I can use against you; I just need a clear declaration that I am not a Canadian citizen so that IRCC and CBSA will stop allowing other countries to deport me here.
