Dear Mr. Eby:
On 2021-08-12 I was released from FRCC upon completion of my 16.5 month sentence for allegedly failing to take down the desicapuano.com website as required by my probation order.
On 2021-08-17 I was arrested again for allegedly failing to take down the website in violation of my probation orders.
Do you not realize, Mr. Eby, that every time you guys prosecute me for failing to take down the website and the website remains online, you are proving that the statements in the "Dear David Eby" post, about the BC justice system being impotent and ineffectual in this matter are, in fact, true?
And here's something for you to wrap your mind around: At the bail hearing on 2021-08-18, Chris Johnson, for the Crown, argued that if I am released I will continue to engage in the conduct which constitutes the breach – that is, I will continue to fail to take down the website – and therefore I need to be detained to ensure I cannot continue to fail to take down the website. And, of course, if I'm detained I have no access to the Internet or to the outside world, so I am effectively prevented from being able to take down the website. The judge saw the idiocy of the Crown's argument but denied me bail based on that argument anyway. Hmm!
